In the last 72 to 24 hours the possibility for a buyer to exit a contract becomes critical. Home sales all generally have this period to some degree. The homeowner’s association disclosure. The disclosure says, “If to be made a part of the contract, if the disclosure summary required… has not been provided to the prospective purchaser before executing this contract for sale. This contract is voidable by the buyer by delivering to seller or seller’s agent or representative written notice of the buyer’s intention to cancel within 3 days after receipt of the disclosure summary or prior to closing, whichever occurs first…”
Uh Oh.
The buyer then may decline to sign unless the homeowners disclosure has already been provided. The meaning of the contract has to be parsed carefully but not having all disclosures in place in Florida real estate transactions may lead to an eleventh hour failure of your contract.
